Depending on the type of charge and severity, there are two different courts where cases may be heard. District court is where traffic matters, misdemeanor cases, and felony cases originate. All three types of cases can be resolved in District Court. The District Courts are where most misdemeanor and traffic cases are heard. District Court can also resolve felonies if the state has extended a plea offer that is a misdemeanor. Another important function of District Court is to conduct bond hearing on misdemeanors, felonies, and even sometimes DWIs.


There are several reasons a case is in Superior Court. This is the highest trial court level, and it is where felonies must be resolved. While felony cases begin in district court, unless the district attorney amends the charges to misdemeanors, all felony pleas and trials must be handled in Superior Court. In addition, appeals to misdemeanor cases are heard in Superior Court. Superior Court is a part of the court system in surrounding North Carolina counties.

Class E – 31 Months Active (I/A)

  • Assault with a Deadly Weapon Inflicting Serious Injury

  • Sell/Deliver A Controlled Substance within 1000 feet of a school

Class F – 20 Months Active (I/A)

  • Assault Inflicting Serious Injury on a Law Enforcement Officer
  • Failure to Register as A Sex Offender
  • Habitual Driving While Impaired
  • Hit and Run Resulting in Serious Bodily Injury or Death
  • Involuntary Manslaughter
  • Malicious Conduct by a Prisoner
  • Possession with Intent to Deliver Meth Precursor
  • Possession of a Weapon of Mass Destruction
  • Stalking – Second Offense


Class G – 16 Months Active (I/A)

  • Child Abuse Serious Bodily Injury

  • Sale of Schedule 1 or 2 Of A Controlled Substance
